TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of courses, content, and services provided by Fluent with Shivi (“we”, “our”, “us”) hosted on the Thinkific platform (“Thinkific”).

By creating an account, enrolling in a course, or making a purchase, you agree to these Terms.

1. PLATFORM ACKNOWLEDGEMENT

You acknowledge that:

• All courses are delivered through Thinkific’s learning management system
• Access is granted digitally upon successful payment
• Thinkific may process login, email, and usage data required for course delivery

2. DIGITAL PRODUCT DELIVERY (IMMEDIATE ACCESS)

Upon successful payment:

• You receive instant or near-instant access to course materials
• This constitutes full delivery of the digital product
• Access is personal, non-transferable, and time-based (if applicable)

No physical goods are shipped.

3. ACCOUNT CREATION & SECURITY

To access courses, you must create a Thinkific account.

You agree:

• To provide accurate information
• Not to share login credentials
• You are responsible for all activity under your account
• Any sharing of access may result in immediate suspension with no refunds

We reserve the right to revoke access through Thinkific if suspicious activity is detected.

4. STRICT NO REFUND POLICY (ALL COURSES AND DIGITAL PRODUCTS)

All purchases are final and non-refundable.

By enrolling, you agree that refunds will NOT be issued for:

• Change of mind
• Lack of usage or time
• Difficulty understanding content
• Expectation mismatch
• Accidental purchase after accessing content

5. CHARGEBACK AGREEMENT

You agree that:

• You will not initiate chargebacks before contacting support
• All disputes must first be submitted via email support
• Initiating a chargeback without communication is a breach of these Terms

In case of chargeback:

We may provide Thinkific/Stripe/PayPal with:

• Login timestamps
• IP address logs
• Course access history
• Enrollment confirmation
• Platform usage data

We reserve the right to permanently revoke access upon chargeback initiation.

6. INTELLECTUAL PROPERTY

All course content on Thinkific is owned by Fluent with Shivi, including:

• Videos
• PDFs
• Worksheets
• Course structure
• Lessons, scripts, and branding

You are granted a limited personal-use license only.

You may NOT:

• Share access
• Download and redistribute content
• Reupload content elsewhere
• Teach or resell course material

Violation results in immediate termination and legal action.

7. COURSE RESULTS DISCLAIMER

We do NOT guarantee:

• Fluency in a specific timeframe
• Job placement or income results
• Academic or immigration outcomes

Your results depend on your personal effort and practice.

8. PLATFORM AVAILABILITY

You acknowledge that:

• Course access depends on Thinkific platform availability
• Temporary downtime or technical issues may occur
• We are not responsible for Thinkific outages

9. USER CONDUCT

You agree not to:

• Abuse the platform
• Share login access
• Copy course materials
• Engage in fraudulent activity

Violation may result in permanent ban and legal action.

10. TERMINATION OF ACCESS

We reserve the right to suspend or terminate access if:

• Terms are violated
• Fraud is suspected
• Chargeback is filed
• Platform abuse occurs

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• We are not liable for indirect damages
• We are not responsible for personal or business outcomes
• Liability is limited to the purchase amount where legally applicable

12. GOVERNING LAW

These Terms are governed by the laws of Ontario, Canada.

13. CHANGES TO TERMS

We may update these Terms at any time. Continued use of Thinkific courses = acceptance.
